  25. Software License Agreement
  26. This is a legal agreement between you, the end user, and Bethesda Softworks, a
  27. division of Media Technology Limited.  By opening this sealed package, or using
  28. the software, you agree to be bound by the terms of this agreement.  If you do
  29. not agree with the terms of the agreement, return the unused software and all
  30. accompanying items to the place you obtained them within five (5) days of
  31. purchase for a refund. Grant of License: Bethesda Softworks grants you (the
  32. "Licensee") the right to use one copy of the enclosed software program and
  33. written reference materials (the "SOFTWARE") on a single computer at a single
  34. location subject to the terms set forth herein.  Bethesda reserves all other
  35. rights not expressly granted to the Licensee.  You may not transmit or otherwise
  36. transfer the SOFTWARE electronically to a network.

  38. Copyright
  39. This manual, packaging and the SOFTWARE are copyrighted. No part of this manual
  40. or the described SOFTWARE may be copied, reproduced, translated or reduced to
  41. any electronic medium or machine-readable form without the prior written
  42. consent of Bethesda Softworks.

  44. Other Restrictions
  45. You may not rent or lease the SOFTWARE.  You may transfer the SOFTWARE and any
  46. and all accompanying written materials on a permanent basis provided you retain
  47. no copies and the recipient agrees to the terms of this agreement.  You may not
  48. reverse engineer, decompile, disassemble, modify or otherwise create derivative
  49. works based on the SOFTWARE in whole or in part, except as expressly provided
  50. for in this License Agreement.

  52. Limited Warranty Notice
  53. If your software should fail under normal use within 90 days of purchase, return
  54. it to your dealer or directly to us for a free replacement. After 90 days,
  55. enclose $10.00 and return only the specific item of defective software directly
  56. to us.  This Warranty applies to the original purchaser only.  Other than provided
  57. above, should the SOFTWARE prove defective, you, the User, shall assume the entire
  58. cost of all necessary service, repair or correction.

  60. Customer Remedies
  61. Bethesda's entire liability and your exclusive remedy shall be at Bethesda's option,
  62. including repair or replacement of the SOFTWARE that does not meet Bethesda's
  63. Limited Warranty and which is returned to Bethesda with a copy of your receipt.
  64. This Limited Warranty is void if failure of the SOFTWARE has resulted from accident,
  65. abuse or misapplication.  Any replacement SOFTWARE will be warranted for the
  66. remainder of the original warranty period or 30 days, whichever is longer.

  68. No Other Warranties
  69. Bethesda disclaims all other warranties, either express or implied, including, but
  70. not limited to implied warranties of merchantability and fitness for a particular
  71. purpose, and indirect, special or consequential damages resulting from the use of
  72. the SOFTWARE and the accompanying written materials. In no event shall Bethesda's
  73. damages exceed your actual purchase price for the software. This limited warranty
  74. gives you specific legal rights.  You may have other rights, which vary from state
  75. to state.

  77. This agreement is governed by the laws of the state of Maryland.  Address all

  85. Warranty Card and Warranty Protection
  86. To be eligible for warranty protection, the original purchaser only must fill out
  87. and mail in the Warranty Registration Card within thirty (30) days of purchase.
  88. Failure to send in your warranty card within thirty (30) days of purchase will
  89. result in the loss of your warranty protection. Warranty protection is available
  90. only to the original purchaser. In the event of any questions in this regard,
  91. Bethesda Softworks reserves the exclusive right to determine warranty eligibility
  92. and appropriate redress, if any.
